Hale County Bench Warrants Explained
Think of a bench warrant as a judge's arrest order that grows out of a case already open. It usually follows a failure to appear, a failure to comply with an order, or some unpaid court money. Alabama paperwork often says "alias warrant" instead, especially after a missed court date. A capias is another word for a command to take a person into custody. Capias pro fine deals with unpaid court money. Hale County has no separate local capias procedure. So what does the label control? Not access. The county's official Magistrates and Warrants page states that an arrest warrant stays out of public view until it is served, and anyone who suspects a personal warrant is told to appear in person at the Sheriff's Department.
Hale Uses Alias Warrant Language
Alabama Form C-65a is titled an alias warrant of arrest for failure of a defendant to appear. That title explains a lot. So a Hale County court record may never use the words "bench warrant" anywhere. Both phrases can cover process after a missed court event, but the filed form and the judge's signed order control what happens next.
- Bench warrant
- Plain-language term for a judge’s arrest order tied to a missed court obligation.
- Alias warrant
- Alabama form terminology often used after nonappearance.
- Failure to appear
- Missing a required date or not resolving a matter by its deadline.
- Recall or quash
- A court’s withdrawal or setting aside of the warrant.
- Clearance notice
- A Clerk document that may be needed for an ALEA traffic-license matter.
Give the clerk both numbers for a traffic case, the case number and the citation number. Similar terms can mean different filings or stages in Hale County.
How Hale County Bench Warrants Are Issued
Rule 3.1 of the Alabama Rules of Criminal Procedure spells out when warrant process is allowed and how a failure to appear after a summons can produce an arrest warrant. The court sets an obligation first. A summons, ticket, notice, or order does that job. If the person does not appear, pay, or comply as required, a Hale County judge can authorize further process.
The sequence can be stated plainly: court notice → missed obligation → judicial decision → alias or bench warrant → service or court recall. Rule 3.3 then governs execution and return. The Sheriff, municipal police, State Troopers, and other authorized officers may serve process. The Clerk records the return and later court action.
Note: A bench warrant does not arise from a clerk’s choice; the judge controls issuance and any later recall.
Missed Hale Traffic Court Date
The Hale traffic page prints the date on the ticket. Payment must beat that date when allowed. State instructions warn what a failure to appear or resolve can bring: contempt, an alias warrant, a late fee, and an ALEA license suspension. And some offenses cannot be paid online at all. Those charges require an appearance in a Hale County courtroom.
- Keep the UTC, case number, ticket, notices, and receipts.
- Check the Alabama Traffic Service Center after the entry period.
- Contact the Hale Circuit Clerk or District Court about the missed date.
- Ask whether a warrant issued and what appearance the judge requires.
- Obtain written proof of recall, disposition, and any needed ALEA clearance.
The Hale Circuit Clerk cannot grant a continuance. In Hale County, the request must be written. Address it to the judge and include the case number. A request alone does not extend the date or stop a warrant.
Bench Warrants and Arrest Warrants Compared
Both tools can put a person in custody. The difference is the starting point. A Hale County bench or alias warrant grows out of a missed obligation in a case already open, while an arrest warrant begins with probable cause tied to an alleged offense. Read the court file rather than trusting the label alone.
| Feature | Bench or Alias Warrant | Arrest Warrant |
|---|---|---|
| Usual trigger | Missed appearance or failure to comply | Probable cause of an offense |
| Case setting | Existing ticket or court matter | Charging or arrest process |
| Authorization | Judge handling the obligation | Judge or magistrate on lawful grounds |
| Next step | Issuing court controls recall and appearance | Arrest, initial appearance, release, or bond process |
A summons orders appearance without any arrest. If it goes unanswered in Hale County, Rule 3.1 may let arrest process follow.
Paying Online May Not Clear Hale Warrants
The Alabama Traffic Service Center and AlaPay handle eligible traffic matters. Online payment still has limits. Paying covers the money owed. It does not, by itself, prove a judge recalled an alias warrant. License status may not bounce back right away either. The Traffic Info page says the Circuit Clerk can issue a clearance notice for ALEA once a matter is paid or resolved, and in Hale County the person may have to deliver that document.
Caution: Keep the payment receipt, then confirm warrant recall and any ALEA clearance with the Hale issuing court.
The AlaPay portal adds a four-percent website convenience fee. That charge is not a warrant fee, bond amount, or recall cost, and Hale County publishes no warrant-clearance fee or current bond schedule.
Resolving a Hale County Bench Warrant
The issuing court holds the only real remedy. The Sheriff serves process and cannot recall warrants. The Clerk can explain filing and scheduling procedure in a Hale County case but cannot choose a legal strategy for anyone. An Alabama lawyer can ask whether a motion to recall or quash fits the situation and help plan the court appearance.
- Confirm the case, warrant status, and issuing court.
- Ask a lawyer about recall, quash, appearance, and bond procedure.
- Follow the court’s directions for a written motion or court date.
- Resolve the missed obligation without assuming payment alone is enough.
- Request written proof that the warrant and related hold are cleared.
Caution: Hale publishes no amnesty event, walk-in recall docket, one-click clearing portal, or guaranteed after-hours surrender schedule.
Do not borrow a procedure from another Alabama county, because local judges and local court calendars control what happens in a Hale County case.
Failure to Appear and Hale License Holds
A missed traffic date can trigger two separate consequences: court arrest process and an ALEA license suspension notice. One may clear while the other lingers. A receipt only proves payment. A recall order addresses the warrant, and a Clerk clearance notice supports the separate ALEA step in Hale County.
| UTC or case number | Identifies the traffic matter with the court and state service. |
|---|---|
| Payment receipt | Shows a transaction, not necessarily recall or license clearance. |
| Recall or disposition order | Shows the issuing court’s action on the warrant or case. |
| Clearance notice | Clerk proof that may need to reach ALEA. |
Ask each office what it still needs. The state Driver License Division can be reached at (334) 242-4400 and driverlicenseinfo@alea.gov, but ALEA cannot recall a Hale County court warrant.
Finding the Court That Issued the Warrant
Hale County splits warrant work by court. Felony prosecutions and post-indictment felony process belong to Hale Circuit Court, while Hale District Court handles misdemeanors, traffic, preliminary hearings, and certain pre-indictment felony work. Greensboro Municipal Court covers Greensboro police-jurisdiction misdemeanors and traffic. Outside the cities, Hale County misdemeanors and other listed complaints run through the Hale Warrant Magistrate process.

Before you pay anything in Moundville, check with the Hale District Court source. That page holds the key fact. Moundville no longer runs a municipal court, and police traffic filings now go straight to District Court, so the county District Judge page settles which door to knock on in Hale County.
Hale County Alias Warrant Access
Hale County keeps alias warrant access tight. An unserved alias warrant may not be released as a public record. A served return is a different story: the Circuit Clerk or the Sheriff can produce it if you name the court and a date range. Redaction, sealing, and confidentiality rules still apply. Alabama Code §36-12-40 gives you the public-record starting point. Section 36-12-43 separates standard requests from time-intensive ones. Juvenile law-enforcement records stay confidential under separate law. In short, asking Hale County for a served return beats demanding an active list the county does not publish.
Note: A missing public file may reflect lawful access limits rather than proof that the bench warrant was recalled.
Documents for a Hale Bench Warrant Call
Court staff can only find what you can describe. Bring the full name used in court, the date of birth, and a UTC or case number. Add the ticket, any appearance notice, a payment confirmation, and any letter from ALEA. Say where the matter arose: Greensboro, elsewhere in Hale County, or through a state trooper. Then ask narrow questions. Which court issued the process? Is the warrant still open, and has a return been filed? Does the judge want a written motion or a live appearance? Is a bond set? Must the Clerk issue a separate clearance? Hale County publishes no bond table or recall form, so get current directions from the court itself. Hale County Continuance Requests Go to Judges
A continuance asks the court to move a scheduled event. That is not the same as recalling a bench warrant, and Hale County's traffic instructions say the Clerk cannot grant one. The written request must go to the judge, with the case number attached. You can hand-deliver it to the Clerk's office or mail it there for court handling. Sending it does not promise approval, though. Timing matters here. Never assume the original date vanished just because a letter went out. Confirm that the judge actually entered an order. Ask whether a new date was set. Ask too whether any alias warrant issued before or after the request, and keep a copy of the letter plus proof of delivery alongside the ticket and court notices. If the original date has already passed, ask directly about warrant status instead of just requesting a new setting. The court may need to handle both the missed event and the underlying charge. A lawyer can sort out a pending continuance request from a recall motion and the appearance needed to resume the case in Hale County.
